Welcome to GoToto. These Terms & Conditions ("Terms") govern your use of the GoToto mobile application and website (together, the "Platform"), operated by [Company / Proprietor name] ("GoToto", "we", "us"). By creating an account or using the Platform, you agree to these Terms.

1. About our service

GoToto is a technology platform that connects riders with independent Toto (e-rickshaw) and bike drivers ("Driver-Partners") for short, local trips and parcel delivery. GoToto itself does not provide transport services; the trip is provided by the Driver-Partner. We only facilitate the booking, routing and payment.

2. Eligibility & account

• You must be at least 18 years old to book a ride.
• You must register with a valid mobile number and verify it via OTP.
• You are responsible for keeping your account and OTP secure, and for all activity under your account.
• You agree to provide accurate information and to keep it up to date.

3. Bookings & rides

• Routes are calculated to use small / neighbourhood roads and to avoid restricted main roads where Totos are not permitted. Routing is provided on a best-effort basis and may not always be exact.
• The estimated fare and time shown before booking are estimates. The final fare may vary based on the actual distance, route and waiting time.
• Share the trip start OTP with your Driver-Partner only when your ride begins.
• You agree to behave respectfully toward Driver-Partners and not to carry illegal or hazardous goods.

4. Fares & payments

• Fares may be paid by cash to the Driver-Partner or by the digital methods offered in the app (UPI, cards, wallet), where available.
• Applicable taxes and any platform/convenience fee will be shown before you confirm.
• For cash rides, you are responsible for paying the correct fare directly to the Driver-Partner.

5. Cancellations

You may cancel a booking before the ride starts. A cancellation fee may apply if you cancel after a Driver-Partner has been assigned and is on the way, as shown in the app. Driver-Partners may also cancel in limited situations (for example, if they cannot reach the pickup point).

6. Driver-Partner terms

• Driver-Partners must hold valid documents and permits required to operate their vehicle under applicable law.
• Driver-Partners are independent contractors and not employees of GoToto.
• GoToto may charge a commission or subscription fee, communicated separately in the Driver app.

7. Acceptable use

You agree not to misuse the Platform, including by attempting to defraud, harass, or harm others, interfering with the app, or using it for any unlawful purpose. We may suspend or terminate accounts that violate these Terms.

8. Liability

To the extent permitted by law, GoToto is not liable for the acts or omissions of Driver-Partners or riders, or for indirect or consequential losses. Our total liability for any claim relating to a trip is limited to the fare paid for that trip. Nothing in these Terms limits liability that cannot be limited under applicable law.

9. Changes to these Terms

We may update these Terms from time to time. Continued use of the Platform after changes take effect means you accept the updated Terms.

10. Governing law

These Terms are governed by the laws of India. Subject to applicable law, the courts at Kolkata, West Bengal shall have jurisdiction over any disputes.
